People do not like restrictions, but some simple rules of conduct must exist for all to live in harmony. A fine of up to $100.00 per incident shall be levied against the owner(s) of the unit who fails to comply with this provision after being notified of a complaint.

New Residents

Application Approval:

All new residents, whether owners or tenants, must be approved by the Board of Directors before moving into Metro at Michigan Park. Residents must file application on the association’s most current application form and include a check or money order for $100 to process a criminal and credit background check. This is not an association rule, but is included in the declaration of the condominium documents. A homeowner must be current with their HOA fees in order for the Board of Directors to consider a resident an application for the unit. Every resident must be approved through the association before moving in.

New Resident Orientation:

After preliminary approval of a resident application by the board, the new resident may move into their unit, but is required to attend a New Resident Orientation in order to be officially approved through the association. New residents must attend an orientation within one month of moving into their unit. At the New Resident Orientation, the new resident will obtain their parking permits, common area keys and the board will verify that their pets are in accordance with these Rules & Regulations. If a resident does not attend a New Resident Orientation within one month after moving into their unit, their application is not officially approved and will be subject to the policies of an unapproved resident living in the unit.

Guests

Violation of the following may result in guest(s) vehicle(s) being towed at the owner’s expense and without prior warning. The following conditions will dictate when the association will be notified of guest(s at Metro at Michigan Park Condos:

Short-term Guest(s):

Three (3) guests of fewer for more than 3 nights
more than 3 guests up to three (3) nights

Long-term Guest(s):

any number of guests for more than 3 nights, but less than 14 nights.

Conditions:

  1. Owners/residents requesting prolonged (greater than 14 nights) guest(s) permission will be addressed by the Board of Directors board on a case by case basis. For such guests, the Board of Directors will be allowed sufficient time to consider the request. This time will be at most 7 nights into said guest(s) stay.
  2. Any person staying longer than one (1) month will be required to complete an application for residency.
  3. Short & Long-term guest must have an association-issued guest parking permit.
  4. Any person that does not meet the above definitions/conditions need not notify the association.
  5. Each request for guest permission will include:

    • Guest(s) first and last name
    • Guest(s) vehicle description, including license plate number
    • Guest(s) relationship to resident
    • Purpose of stay for guest(s) defined as long term or greater above.
    • Guest(s) date of departure.

Parking

Upon acquiring a fee simple title, each owner shall be assigned a parking space. The said parking space is designated a Limited Common Element. With respect to such Limited Common Element, the owner of the Private Dwelling, being assigned the parking space, shall have the exclusive right to use the same, and such exclusive right shall become an appurtenance to said Private Dwelling and shall be encumbered by or subject to any mortgage then or thereafter encumbering said Private Dwelling. No owner will be assigned more than one (1) parking space. VIOLATION OF ANY PARKING RULES MAY CAUSE A VEHICLE TO BE TOWED AT THE OWNER’S EXPENSE AND WITHOUT PRIOR WARNING!

Assignment of Parking Space Rights

The Owner of the Private Dwelling may not assign the exclusive rights to use said parking space without prior written approval for Board of Directors. A resident may temporarily allow a guest (not defined as a Short or Long-term guest) use of their assigned parking space. In each instance, an 8.5” x 11” page must be clearly displayed in the guest’s vehicle drivers-side dashboard that states:

“This vehicle has temporary permission to park in _________ (enter assigned number) on __________ (date) for less than three nights.”

A copy of this temporary permit may obtained from the association or may be created by the resident giving permission. THIS TEMPORARY PERMIT MUST BE SIGNED BY THE RESIDENT IN ORDER TO BE VALID.

Assigned Spaces & Permits

Any owner who parks a car in another owners’ parking space may without prior written permission from the owner and approval by the Board of Directors may have his or her vehicle towed away by the Association’s designated towing company at owner’s expense. Parking permits are required for all residents and each approved resident will be issued a parking permit which must be clearly displayed on the front driver-side windshield in his/her car at all times while on property. For the protection of our residents, any permit which has been fraudulently obtained by a non-approved resident is invalid and the vehicle with this invalid permit will be towed without prior warning. Visitors may park in any space not assigned to a resident. The residents of each unit may not obtain more than two parking permits for each bedroom of the unit. 1 Bedroom may have up to 2 parking permits, 2 Bedrooms up to 3, and 3 Bedrooms up to 4. If your car is left in the parking space for any length of time during a vacation, a key must be left with one of the Board members for emergency use only.

Each resident must use their assigned spot before using a guest spot. For example: Units with multiple vehicles must have one of those vehicles parked in an assigned spot before a guest spot is occupied.

Commercial Vehicles: No commercial vehicles will be issued a parking permit and are not allowed to be on property overnight.

Other Requirements: Residents must keep their vehicle information current with the Association. A resident must inform the association if they transfer units as a tenant. All vehicles must have a license place and up-to-date registration on the vehicle and clearly visible. All vehicles must be operational. Vehicles must be parked within the lines of any parking spot and may not occupy two parking spaces at one time.

Pets

All pets must be approved by the Board of Directors. Pending approval, a picture or personal meeting with the pet is required and current shot records must be submitted. Normally, the maximum number of pets permitted per unit is two. In units without adjacent patio's to ground floor designated or assigned (usually upstairs units), the weight of the pets should not exceed a combined total of 40 pounds. Units with patio's adjacent to ground floor units designated or assigned (usually downstairs units) will be allowed to have one pet up to 60 pounds. Three dogs are allowed with the total weight of all three dogs does not exceed 30lbs. No pet may be left outside unattended which constitutes or causes an unreasonable amount of annoyance or nuisance to the occupant of another unit. Owners must clean up after pets immediately. Pets shall be leashed at all times and under owner’s complete control. Pet owners are responsible to maintain liability insurance. If the Board of Directors deem a pet unruly or a nuisance, the pet must be removed immediately. No pets are to be unattended in any common area(s) if the owner is not home, this includes private patios. Owners will be fined for violation of pet rules.

No Aggressive Breeds Allowed. This includes, but not limited to, pitbulls, rottweilers, doberman pinschers, akitas, and german shepards.

Unreasonable Noises

Quiet time is between the hours of 10PM and 8AM. Radio, TV and other noise that includes, but is not limited to, barking dogs, shouting, stomping or otherwise being inconsiderate of all downstairs neighbors will not be tolerated. Keep noise to a minimum as some residents may be sleeping. No occupant shall undertake any use or practice, within or around their dwelling, which interferes with the peaceful possession and proper use of any other private dwelling or the common property or limited common property. If hosting a party, or having guests over, be considerate of the quiet time. Maintenance, remodeling or construction work shall begin no earlier than 9:00AM and end no later than 6:00PM, Monday through Saturday. No work of this type shall take place on Sunday.

Trash, newspapers & flattened boxes

All trash bags must be tied. Any trash that will not fit must be neatly placed to the side and never in front of the compactor. The compactor is for normal household trash only! Any large items are the responsibility of unit owner(s). Shut the compactor door after use and breakdown cardboard boxes to prevent a jam in the compactor.

Hurrican Shutters

Temporary hurricane shutters are permitted during hurricane/tropical storm condition. No permanent hurricane shutters shall be installed. You will be held responsible for the damage caused by the installation of temporary shutters.

Common Area Modifications

Any modification of the common area or limited common area must be approved through the Board of Directors.

Common Passageways

Because of municipal regulations, porch furniture, potted plants or any other objects cannot be placed in hallways, stairwells, and breezeways. No carpeting is to be placed in hallways, stairwells or breezeways. Doormats are acceptable up to the size of two (2) feet by three (3) feet (standard size). Please be considerate of owners below when sweeping and washing the breezeway.

Outdoor Cooking

Outdoor cooking (grilling) is only permitted to be done in the volleyball court. Grills may not be used or stored in any other common area including patios and other common elements. A fine of $500 will be assessed to each owner for violation of this rule, per the Florida Fire Marshall.

Soliciting in Buildings

No soliciting in building is permitted without approval of the Board of Directors. If anyone appears at your door, they should be advised soliciting is not allowed without proper approval from the Board of Directors.

Boat/Watercraft Owners

Storage of boats/watercraft, RV’s, or trailers is not allowed on premises. Trailers permitted maximum of two (2) days only.

Laundry Room

Keep laundry room clean and in order
Clean lint containers in the dryer after each use.
Nothing must be stored inside the laundry room.
Signage posted on wall will give contact person for maintenance, service or refunds

Cleaning

No clothing or mats should be hung over railing or expressed in the outside areas. Owners must provide names of cleaning staff hired to the Board of Directors if they possess any keys.

Public Sale

Public sales may not be held on the premises.

Signs

No signs of any kind may be displayed in individual units or in the common area without the permission of the Board of Directors.

Rental Liability Insurance

All owners who rent their units a responsible for carrying a landlord’s liability policy or similar insurance to protect the Association from negligent acts or omission by tenants. Owners are responsible for guests/tenant’s actions

Windows & Doors

All townhouse doors and trim must be painted black and the glass must be frosted. All non-townhouse entry doors must be six-panel, black in color, and the hardware on the door must be silver or chrome. All windows must have two-inch white plantation blinds. No resident may place anything in the windows between the window and window treatment visible from outside the unit (stickers, signs, holiday decorations, etc.)

Limtied Common Areas/Private Patios

Your patio is a limited common area and many contain easements for electrical, plumbing, and other servicing points. If you have a lock on your fence and an emergency occurs, it will be removed without warning. No structure of any type may exceed the height of your fence including canopies, lighting, tiki torches, etc. Be courteous of your upstairs neighbors by keeping your patio neat, clean and aesthetically pleasing.

Mailing Addresses

Mailing addresses and phone numbers must be left with the METRO AT MICHIGAN PARK CONDOMINIUM office whenever leaving apartment for any significant amount of time (over two weeks).

Complaints

All complaints and suggestions to be made to the Board of Directors shall be in writing and signed by the person making the complaint or suggestion, and shall be delivered to the office of the Association.

Driving Speed Limit

The posted speed limited throughout the property is 15 mph. Every person must drive responsibly and safely and be cautious of pedestrians and pets.

Children

Children under the age of 14 must be accompanied by an adult over the age of 18 when anywhere in the common area.

Pool

Pool rules are posted at the pool and each resident must abide by the rules. For safety reasons, the Fining Committee will take proper action if rules are broken.
